Arbitration for Effective Dispute Resolution

The Organization

Established in 1991, Nepal Council of Arbitration (NEPCA) has completed a striving journey of more than three decades gaining a steady ascent in professional delivery and earning nationwide trust, recognition and dignity. It enjoys a vastness of professional strength of more than 350 professional members, the size increasingly expanding with time.

The Council in its journey of more than three decades has taken up more than 1,600 cases and has settled them remarkably. In its initial period, NEPCA had more cases in adjudication, conceived as a shorter process of alternative dispute resolution. Now, the cases of dispute registered are in the order of sixties in a year of which around two-third are for arbitrations and one-third are for adjudication or dispute board settlement. In Nepal, most of the dispute cases involve with the public procurement domain related to construction business. Cases of dispute related to the commercial business have also been received and arbitrated.

The organization is steered by an elected executive committee of 11 members including five officials and six executive members. The organization has formed six business committees. NEPCA owns a well-equipped secretariat headed by executive director and supported with manager and skilled human resources.

Objectives

The Council aims to organize its first ever national conference in Kathmandu, Nepal. The objectives to organize the conference include,

  • To pursue something new, bold and beyond the traditional activities
  • To explore the trends in effective dispute resolution
  • To enhance academic interactions and networking amongst institutions and professionals national level
  • To provide a national platform to present, interact and enhance professional discussion among Nepalese arbitrators and benefit from each other
  • To provide forum for professionals/practitioners/researchers to share their findings and enhance their competence through better understanding of alternative dispute Resolution

This conference will be the first event of national stature in the sector of alternative dispute resolution in Nepal.

Main theme of the National Conference

Main theme of the natonal conference is “Arbitration for Effective Dispute Resolution.” The term ‘Effective Dispute Resolution’ understandably involves integral terms such as timeliness, cost effectiveness and quality decisions with fairness and lawfulness.

The sub themes of the conference includes but not limited to the following:

  • Arbitration practices and challenges
  • ADR in public procurement
  • Arbitration in the changing context of the 21st century
  • Competitive neutrality in public procurement
  • Use of technology in pandemic situation such as Covid-19 in delivering arbitration
  • The issue of competitiveness, transparency and accountability in dispute resolution
  • Law vs. Justice in arbitration decision making
  • Role of NEPCA in the aspect of time, cost and quality in arbitration award
  • Enforecement and implementation of arbitration award

Call for papers

Papers are invited from professionals, practitioners and scholars on any of the subthemes mentioned above or in related topic.

The papers will be subject to review and acceptance by a review committee.
